Referral Programme Terms and Conditions
Thank you for your interest in the Obsidian Healthcare Recruitment Referral Programme (“Programme”). These Terms and Conditions (“Terms”) govern your participation and outline your rights, obligations, and responsibilities when submitting referrals to Obsidian Healthcare Recruitment (“Obsidian,” “we,” “us,” or “our”).
Participation in the Programme constitutes your acceptance of these Terms.
1. Referrer Eligibility
1.1 Participation is strictly limited to healthcare workers who are currently engaged, contracted, or registered with Obsidian Healthcare Recruitment at the time the referral is submitted.
1.2 Referrals of individuals who have been registered, employed, or otherwise engaged by Obsidian within the previous two (2) years from the date of referral submission are not eligible.
1.3 Referrers must be at least 18 years old and legally entitled to work in the United Kingdom.
1.4 Self-referrals or referrals made on behalf of oneself are strictly prohibited and will result in immediate disqualification from the Programme and forfeiture of any bonus.
1.5 Obsidian reserves the right to verify eligibility at any time and reject any referral that does not meet these criteria.
2. Referral Submission and Candidate Consent
2.1 All referrals must be submitted via the official Obsidian referral form on our website or through an authorised secure submission portal.
2.2 The referrer must obtain the referred candidate’s explicit, informed consent before sharing their personal information with Obsidian.
2.3 Obsidian complies with the UK GDPR and the Data Protection Act 2018, ensuring all personal data is processed lawfully, securely, and confidentially.
2.4 Any misuse, unauthorised disclosure, or unlawful handling of personal data by the referrer may result in disqualification and possible legal action.
3. Candidate Registration and Compliance
3.1 Referral eligibility depends on the candidate completing the full UK compliance and registration process, which may include:
Enhanced DBS Check
Verification of professional registration (e.g., NMC, HCPC, GPhC)
Proof of qualifications
Mandatory training verification
Right-to-work and identity checks
Employment history and reference checks
3.2 Obsidian may reject or disqualify any candidate who fails to successfully complete registration or compliance checks within a reasonable timeframe.
3.3 The date that the candidate becomes fully compliant and activated on our system marks the start of hours counting toward bonus eligibility.
4. Service Hour Requirement and Placement Conditions
4.1 The referred candidate must complete a minimum of 150 hours of work through Obsidian within six (6) months of completing registration.
4.2 All work must follow the relevant NHS, CQC, and UK Health & Safety requirements, including adherence to professional standards and workplace regulations.
4.3 Only hours worked through Obsidian’s official scheduling and payroll systems count toward the bonus.
4.4 Cancelled shifts, unpaid hours, or work completed outside Obsidian assignments do not qualify.
5. Referral Bonus Payment and Verification
5.1 Referral bonuses are payable only after Obsidian verifies that the referred candidate has completed both full registration and the required hours.
5.2 Obsidian performs all verification internally; referrers are not required to track hours.
5.3 Bonus payment will be made within 28 calendar days following verification, although delays may occur due to operational or banking factors.
5.4 Referral bonuses are subject to UK tax and statutory deductions.
5.5 Obsidian may withhold or reclaim bonuses if any fraudulent activity or breach of these Terms is identified.
6. Referral Submission Requirements and Limitations
6.1 All submissions must be accurate and complete. Incorrect or incomplete referrals may be delayed or rejected.
6.2 If multiple referrers submit the same candidate, the bonus will be awarded to the first valid referral received based on timestamp.
6.3 Obsidian may reject any referral due to ineligibility, misconduct, misrepresentation, or breach of these Terms.
6.4 Multiple referrals are permitted, but each candidate must be submitted individually.
7. Geographic and Legal Compliance
7.1 Referred candidates must have the legal and unrestricted right to work in the United Kingdom.
7.2 Obsidian does not provide visa sponsorship as part of this Programme.
7.3 Referrals of candidates residing outside the UK are ineligible unless explicitly stated otherwise.
7.4 Obsidian operates in full compliance with UK employment law, anti-discrimination legislation, NHS framework standards, and UK GDPR requirements.
8. Claiming Your Referral Bonus
8.1 Once the referred candidate completes the required hours, the referrer must contact Obsidian at enquiries@obsidianhealthcarerecruitment.com with:

8.2 Obsidian will confirm eligibility and respond within 14 business days.
8.3 Failure to claim the bonus within 6 months of the candidate meeting the requirement may result in forfeiture.
9. General Provisions
9.1 Obsidian may amend, suspend, or terminate the Programme or these Terms at any time without prior notice.
9.2 These Terms are governed by the laws of England and Wales.
9.3 Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
9.4 Participation does not constitute an offer of employment for any referred candidate.
9.5 Obsidian’s decision on all matters relating to the Programme is final and binding.
